(Bill amendment) Temporary suspension of works due to possessory actions submitted by holders of mining concessions
Bill amendment proposed by Representative Mr. Matheson (July 10, 2023): Whether the holder of a mining concession submits a possessory action pursuant to article 94 of the Mining Code, the Court may order the temporary suspension of works carried out over the surface land the overlaps the mining concession, provided such holder, in addition to prove to be the holder of a right in rem encumbering the surface land, submits background information that proves a serious and imminent danger involved in the non-granting of such temporary suspension. The holder of works carried out over the surface land is entitled to lift the suspension by placing a bond with the relevant Court.
